Terms of Use
These Terms of Use (hereinafter referred to as the "Terms") govern the conditions for the use of the Service (as defined in Article 1) by users (as defined in Article 1; hereinafter "Users"). By using the Service, Users must fully review and agree to all provisions of these Terms.
Article 1: Definitions
- "Application": The application provided by the Company within Japan.
- "Official Website": The official website of the Application operated by the Company, accessible via links within the Application.
- "Service": The Application and related services provided alongside it.
- "User": Any person who uses or intends to use the Application.
- "User ID": A unique string assigned by the Company to identify Users and provide after-sales support (including combinations of characters, passwords, codes, etc.).
- "Mobile Device": Smartphones, tablets, or other information devices capable of installing the Application.
- "Paid Points, etc.": Items or virtual currency (including points for accessing specific services or exchanging in-game items) issued in exchange for payment from Users.
- "Points, etc.": Items or virtual currency used within the Service (including Paid Points, but not limited to them).
Article 2: Application and Modification of the Terms
- Users must agree to these Terms when installing the Application and commencing use of the Service. Agreement constitutes a contract (the "Usage Agreement") between the User and the Company under these Terms.
- Guidelines or rules posted on the Application or Official Website (collectively, "Guidelines") form part of these Terms. In case of conflict, Guidelines prevail.
- The Company may modify these Terms at any time without prior consent. Changes take effect upon posting unless otherwise specified. Reasonable prior notice may be provided.
- Continued use after modification constitutes acceptance. Users who disagree must cease using the Service.
- Users must periodically check the Official Website for updates.
- The Company bears no liability for damages due to User failure to review changes, except in cases of Company intent or gross negligence.
Article 3: Installation of the Service
- Users shall install the Application only on their own Mobile Devices (or those owned by a legal guardian if the User is a minor).
- Users are responsible for preparing devices and services (e.g., internet) required to use the Service.
- Users shall not install the Application on excessive devices or obtain multiple User IDs improperly.
- The Company bears no liability for damages arising from lending, transferring, or selling devices with the installed Application, except in cases of intent or gross negligence.
Article 4: Use by Minors
- Minors must obtain parental/guardian consent to use the Service. Violations may result in termination of the Usage Agreement.
- Use after reaching adulthood constitutes ratification of prior use as a minor.
- The Company may restrict Service access based on age.
Article 5: User ID Management
- User IDs may be assigned per User, device, or Application.
- Users are solely responsible for managing their User IDs.
- All activities under a User ID are deemed the User’s responsibility. The Company bears no liability for third-party misuse, except in cases of intent or gross negligence.
- Users shall not lend, transfer, sell, or otherwise permit third parties to use their User ID.
Article 6: Acquisition and Use of Points, etc.
- Paid Points may be purchased via methods specified by the Company.
- Points, etc., are non-transferable and usable only within the Service as specified. Users acquire no ownership or intellectual property rights.
- Paid Points designated as prepaid payment instruments under the Payment Services Act are treated accordingly. Other Points are deemed provided upon acquisition.
- Minors may face purchase limits based on age.
- Points expire upon Service termination unless otherwise specified.
- Points may not be exchanged for cash, transferred, or used outside the Service without permission.
- The Company may correct Point balances without notice.
Article 7: Discontinuation of Points, etc.
- The Company may discontinue Points at any time, with reasonable prior notice.
- The Company bears no liability for expired Points, except as required by law or in cases of intent/gross negligence.
Article 8: Fees
- Fees for Paid Points or the Application are payable in advance via Company-specified methods.
- Fees, payment deadlines, and methods are posted on the Application or Official Website.
- The Company may modify fees or payment terms at any time, effective upon posting.
- Users must comply with third-party payment processor terms. Disputes with processors are resolved by Users.
- Fees are non-refundable except in cases of Company intent/gross negligence.
Article 9: Personal Information
- The Company may collect Users’ personal information (as defined under Japanese law).
- Handling of personal information follows the Privacy Policy accessible via the Application or Official Website.
Article 10: User-Generated Content
- Users may submit content (text, images, data, etc.) via the Service.
- Users are solely responsible for their content.
- Users warrant that content does not infringe third-party rights (e.g., IP, privacy).
- Users resolve third-party disputes arising from their content at their own expense.
- The Company may freely use, modify, or distribute User content without compensation.
- The Company may remove content without notice.
Article 11: Game Data
- Game data (items, characters, levels, etc.) is usable only within the Service. Ownership remains with the Company.
- The Company may modify or delete game data for operational reasons, Service termination, or User violations.
- The Company bears no liability for such changes, except in cases of intent/gross negligence.
Article 12: Prohibited Acts
Prohibited acts include, but are not limited to:
- Harassment, threats, discrimination, or offensive language.
- Impersonation of Company staff.
- Defamation, illegal activities, or commercial solicitation.
- Infringing IP rights, unauthorized access, cheating, or distributing pirated software.
- Excessive installation of the Application or obtaining multiple User IDs.
- Transferring/selling User IDs or Points.
Article 13: Suspension of Service
The Company may suspend access if Users violate these Terms, engage in payment fraud, breach third-party processor terms, or disrupt operations.
Article 14: Termination of the Usage Agreement
- The Agreement terminates upon User deletion of the Application (unless data is migrated) or Service termination.
- The Company may terminate the Agreement for prior suspensions, inactivity, User death, or operational necessity.
- Immediate termination is allowed for severe violations.
- The Company bears no liability for termination damages, except in cases of intent/gross negligence.
Article 15: Service Modifications, Termination, or Interruption
- The Company may modify, terminate, or interrupt the Service at any time with reasonable notice (where possible).
- The Company bears no liability for such actions, except in cases of intent/gross negligence.
Article 16: Disclaimers
- The Service is subject to change. The Company guarantees no permanence.
- The Service is provided "as is" without warranties of accuracy, compatibility, or non-infringement.
- Users use the Service at their own risk. The Company disclaims liability for excessive or harmful use.
- The Company bears no liability for third-party attacks (e.g., viruses, unauthorized access).
- Users indemnify the Company for third-party disputes arising from their use.
Article 17: Liability
- Users compensate the Company for damages caused by breaches of these Terms.
- The Company’s liability for damages (excluding intent/gross negligence) is limited to fees paid by the User.
Article 18: Intellectual Property
- All Service content (text, images, programs) is owned by the Company or licensors. Unauthorized use is prohibited.
- Trademarks displayed belong to the Company or third parties.
- Users may not register Service-related IP rights.
Article 19: Validity
If any provision is invalid, the remainder remains enforceable.
Article 20: Special Provisions
None.
Article 21: Governing Law and Jurisdiction
- These Terms are governed by Japanese law.
- Disputes shall be resolved in the Tokyo District Court.
